Appeals & CCRC

Conviction and sentence appeals, abuse of process arguments, and applications to the Criminal Cases Review Commission.

A conviction is not always the end of a case. If you believe yours is unsafe, or your sentence manifestly excessive, there are routes to challenge it — and strict time limits that make early advice essential.

We are frequently instructed after trial by clients who were represented elsewhere, and we will give an honest view on whether an appeal has prospects rather than an encouraging one.

In R v R the defendant, who had a previous terrorism conviction, faced a charge of possessing explosives. The case was dismissed by the judge on abuse of process grounds. The Crown appealed and the Court of Appeal upheld the dismissal. In a separate matter, a conviction under sections 57 and 58 of the Terrorism Act 2000 relating to downloading material was subsequently quashed by the Court of Appeal.

Two further terrorism convictions in which the firm has been involved are currently under review by the Criminal Cases Review Commission.

Advice at the police station is free to everyone. It does not depend on what you earn, and it does not commit you to instructing us afterwards. If you have been asked to attend an interview about appeals & ccrc, call before you go.
